These terms and conditions ("Consumer Terms and Conditions") regulate your use of this web site which you will need to access to purchase a Buccleuch on-line gift voucher (the "Web Site"). By reading and accepting these Consumer Terms and Conditions, you will be bound by them. Buccleuch Sporting Ltd reserves the right to vary these Consumer Terms and Conditions. It is your responsibility to regularly review these Consumer Terms and Conditions before each purchase to keep up to date with any alterations.

1. Purchasing 1.1 Buccleuch Sporting Ltd Web Site offers gift voucher experiences ("Gift Voucher") for sale. 1.2 Agreement for the sale of any Gift Voucher will only exist between you and Buccleuch Sporting Ltd, when your order has been accepted by email confirming payment and full details of the Gift Voucher purchased and the recipients details (the "Confirmation"). The Confirmation amounts to an acceptance by Buccleuch Sporting Ltd of your offer to buy gift voucher(s) from Buccleuch Sporting Ltd. It is your responsibility to check that the details of the Confirmation are correct as soon as possible and keep a copy. 1.3 Payment shall be taken by PayPal or directly at Buccleuch Sporting Ltd by credit or debit card (Mastercard, Visa, Delta or Switch). PayPal protects your financial information with industry-leading security and fraud prevention systems. When you use PayPal, your financial information is not shared with Buccleuch Sporting Ltd. Once your payment is complete PayPal will email you a receipt for the transaction or Buccleuch Sporting Ltd will post you a copy of your receipt. 1.4 When ordering Gift Voucher from Buccleuch Sporting Ltd you agree that all details you provide are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the Gift Voucher ordered.

2. Supply - 2.1 Each Gift Voucher sold is subject to their own specific terms and conditions of let and will require completing when booking the experience. 2.2 We shall be responsible for issuing, posting first class (or special delivery if requested) and performing any other terms set out in the Confirmation.  Gift Voucher(s) will be supplied by posting within two (2) working days of the Confirmation, you should take into account that it may take longer. We cannot accept liability for any delay which may occur in the delivery times. The Gift Voucher supplied must be presented on arrival to redeem the experience.

3. Refunds and Returns - 3.1 Terms and conditions which apply to the Gift Voucher will be specific to each individual experience and will be included for signing and return with supply of the Gift Voucher.  3.2 All Gift Vouchers are non-refundable and non-transferable unless otherwise agreed by us and will not be exchanged for cash or replaced if lost. 3.3 All specific arrangements regarding booking dates and times must be made directly with Buccleuch Sporting Ltd, and you should reconfirm arrangements the week prior to the experience to avoid disappointment. We will use all reasonable endeavours to meet your request but cannot guarantee any specific date or time. 3.4 Your statutory rights are not affected.

4. Liability - 4.1 This section applies only to the extent permitted by law. For the avoidance of doubt, Buccleuch Sporting Ltd do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from Buccleuch Sporting Ltd negligence or wilful default, or that of Buccleuch Sporting Ltd employees, agents or subcontractor or (b) fraudulent misrepresentation. 4.2 In the event that Buccleuch Sporting Ltd breach their contract with you, Buccleuch Sporting Ltd shall be responsible only for refunding the cost of the Gift Voucher. Buccleuch Sporting Ltd shall not be liable to pay any other compensation or losses suffered by you as a consequence of breach of contract. 4.3 Buccleuch Sporting Ltd agree to provide the services for which the Gift Voucher was purchased in accordance with the description on the Web Site, at all times with reasonable skill and care. Buccleuch Sporting Ltd makes no other warranty or representation.

5. Copyright - The Web Site is protected by copyright, and other intellectual property rights and laws. You may view download part(s) of it to your personal computer for your personal viewing, no content should be downloaded, reproduced, sold, distributed, copied or stored without Buccleuch Sporting Ltd prior written agreement.

6. Privacy - Buccleuch Sporting Ltd is committed to maintaining the privacy of any personal information received from you, working within the principles of UK data protection legislation. By giving us your details you accept that we will be able to use them to send details of any future Buccleuch Sporting Ltd offers.

7. Disclaimer - By accessing and using the Web Site, or any of the information on it, you acknowledge that, while Buccleuch Sporting Ltd have taken reasonable endeavours to ensure that all information contained on the Web Site is correct, accurate and up to date, and free from virus, it is your responsibility to take protective steps such as virus checking.

8. Governing Law and Jurisdiction - The Web Site and these Consumer Terms and Conditions are governed by the laws of Scotland. You agree to submit to the exclusive jurisdiction of the Scottish courts in all matters relating to these Consumer Terms and Conditions. If any provision is found to be invalid you agree that the other provisions will remain in full. If you access the Web Site from outside the UK you are responsible for compliance with any local laws relating to access.
